You, the buyer, understands that the total purchase price is $1800. This is for a healthy puppy. AKC papers with limited registration will be available with in a few months after you receive your pup. This delay is necessary to prevent people from turning around and reselling the puppy. This puppy is not to be used for breeding. If full breeding rights are granted, a different form will be used. 

Snow Pack's Alaskan Malamutes ( Seller ) cannot guarantee the color, height, weight, or hair length or markings of any of our puppies. Sellers do not provide a guarantee against cryptorchidism (a common condition in purebreds where only one or neither testicle descends). This will not prevent you from neutering your male puppy. IF we fail to produce a litter or sex of choice or not enough puppies, your money / deposit will be transferred to the next available litter. Please take this into consideration when purchasing a puppy. Timing is not an exact science. 

You, the buyer, agree to notify seller if at any time you can not keep the puppy. You agree to give the seller the names, address and phone number of new owners. 

You, as the buyer, agree to love and care for your malamute. You agree that this malamute will never be confined in inhumane conditions. This including being tie up, chained up or kenneled for long periods. You agree to and understand the importance of feeding this malamute quality food and provide it with veterinary care yearly and as needed and keep this malamute up to date on shots. You agree not to abuse or neglect this malamute in any way. Buyer also understands that said puppy is vulnerable to illnesses and diseases when you receive your puppy.  It is also important not to overwhelm your puppy the first few days. Stress can cause intestinal problems including coccidia. All puppies are born with worms. Your puppy will have received at least one worming. This does not clean out all worms and eggs so it is very important that they continue to be wormed. It is also very important to understand that puppies who are stressed can show aggression and this is to be understood that the new owner is putting too much pressure on the puppy and needs to be more patient. It is not the fault of the puppy. It is very important that people understand how to handle and be patient with a young puppy. They need a lot of love and patients and understanding as well as consistency and firmness. It takes months to train a new puppy. 

Payments or deposits from the buyer(s) are non-refundable once they have been received by seller. Seller will not give a refund of cash value to the Buyer for any reason unless seller choose not to sell buyer a puppy.At any time seller has the right to withdraw the sale of said Puppy at any time before shipment, or pickup of puppy. If that should happen seller will give the full refund if seller chooses not to sell the puppy to buyer, no matter what or why and without explanation. Any discrepancies or disagreements with regards to this document must be filed with a court of law in the State of Colorado and the County of Park. Buyer will be responsible for all legal expenses incurred by us in any case filed by the buyer that is ruled in the favor of Snow Pack's Alaskan Malamutes aka Kurt and Kelly Schmid . *PLEASE NOTE: IF YOU MAKE A PAYMENT/DEPOSIT USING PAYPAL, THERE ARE STILL NO REFUNDS FOR THESE TRANSACTIONS. PAYPAL DOES NOT SUPERSEDE OUR BUYER CONTRACT OR POLICIES ON REFUNDS. IF YOU CHOOSE TO REQUEST A REFUND VIA PAYPAL AT ANY TIME THROUGHOUT OUR TRANSACTION, WE WILL HAVE NO CHOICE BUT TO PURSUE LEGAL ACTION FOR DAMAGES. IF WE HAVE TO PURSUE LEGAL ACTION FOR THIS, WE WILL SEEK DAMAGES FOR THE AMOUNT WITHDRAWN PLUS ANY LEGAL FEES, FILING FEES PLUS INTEREST. 

Heath Agreement - Puppy must be seen by a licensed vet within 3 days from the day buyer receive the puppy. This will insure that buyer is receiving a healthy puppy. Please make vet arrangements before picking up your puppy. They must be kept current on all shots and worming. If there is a problem with said puppy, buyer need to provide it with good medical care. If the problem is genetic, buyer must provide seller with veterinary documentation and copies of all testing and lab work that has been done. Documentation must show that it is genetic and will be or is serious enough to alter the quality of the dogs life. Any diagnosis must be within the first 2.2 years from the date the pup was born. Diagnosis of Hip Dysplasia must be made by the OFA and must be grade 4 or worse and must prove that it is genetic. If the puppy is diagnosed and meets this, we agree to provide buyer with a new puppy when one is available. New puppy, vet check and shipping of new puppy will be covered by seller. It will be the buyers choice if they want a new puppy. It will be the buyers choice to keep defective puppy or send him/her back. If buyer decides to keep defective puppy, they will be responsible for all vet costs. They will not be required to send defective puppy back to receive a new puppy, it will be their choice. Seller understands companionship can not be "replaced" so it will not be required. We will not be responsible for any vet bills. We will only give the buyer a new puppy. If the puppy is of full age and size and lives out of state and can not be shipped. The current owner will need to keep the dog or put the dog down if necessary at their expense. I do not like this but it would simply be an unfortunate situation. 

Not Covered by Health Agreement A puppy is vulnerable to many different viruses and illnesses that we can not be responsible for. These are all illnesses that a puppy can come in contact with after leaving sellers home. Since seller has no control over the puppy once it leaves sellers care, seller can not be responsible for those illnesses, viruses or accidents. Buyer understands that no puppy is protected until at least two weeks after the puppy has received the last set of puppy vaccinations. Puppy vaccinations are generally giving at 8, 12, and 16 weeks. This may vary slightly. Puppies are born with worms and it takes several treatments to get rid of all worms. Buyer understands that it is their responsibility to have this treated. Puppy will have first treatment before leaving sellers care. When puppies go to their new home, it is a stressful time for them. Buyer understands that this can lower puppy's immune system making them more vulnerable to infections, viruses and other illnesses. Puppies can come in contact with viruses through physically contact by walking where an infected dog walked, sniffing/touching/eating an infected dogs feces, and some are airborne. Very important - IF you get your puppy home and the puppy starts to act or look sick. There are things you can do. First understand that simply leaving his/her litter mates and mom is a lot of stress. This can lead to dehydration quickly. Make sure your pup gets enough water. Loose stools are common. A little pure canned pumpkin or boiled chicken and rice will help a stressed tummy. Try this first. IF the stools are watery or bloody, you can still try the above. If you do not see improvement or gets worse. A vet trip is necessary. We will not pay for this as we can not prevent it and it is common. It goes along with owning a puppy. Be aware of emergency rooms and vets. They will want to run a lot of tests. This is not necessary. It is almost always coccidia which is caused by stress. 

Puppy Vaccinations - Canine Distemper, Adenovirus Type 2 (CAV-2 cross protection CAV-1), Parainfluenza and Parvovirus Vaccine (MLV) Rabies vaccinations are usually given around 4 months of age. This varies from state to state. This vaccine is your responsibility. Rabies is the only required by law vaccine in the U.S.  Vaccinations - Seller is not responsible for side effects caused by vaccinations.

As of 7/2022 we no longer give vaccines to puppies before they leave.

VISITING - We are located between Hartsel and Lake George off Hwy 24.Please know, we are not liable for any injury or loss to our guests, so be sure that you are fully aware of these risks when coming onto our property. You must fully acknowledge that we will not be held accountable or responsible for anything during or as a result of your visit before we can make an appointment with you. We do not suggest bringing anyone who is disabled or unable to keep good footing as our terrain is extremely rocky and uneven. There are times when there is snow and ice on our property which can pose risks for falls. When you enter onto our property, you enter at YOUR OWN RISK. Our dogs will be locked up at all times during visits, please do not ask us to let them out as they are very powerful and get excited. Moms with pups are very protective over their young, and this is a normal natural response to “strangers” entering onto their turf. This has nothing to do with temperament, it’s mother nature doing it’s job. Their enclosures will allow you plenty of opportunity to view and interact with our Mals.

Genetic Disorders of the Alaskan Malamutes
( brief descriptions )


The Alaskan Malamute is a "natural" breed, the product of its environment and function rather than "man made". The resulting wider gene pool has left the breed relatively free of a large number of inherited medical disorders.
For the sake of clarification, though rare, the list below can effect this breed.


Eyes


Canine Cataracts - We will not cover this if your puppy / dog had received all vaccines as this is a side effect and can be caused by the vaccine. 




Chondrodysplasia (ChD)


Chondrodysplasia is a genetic disorder in the Alaskan malamute, which manifests itself in puppies born with deformities, eventually evident in the abnormal shape and length of their limbs. Although not entirely correct, this condition is commonly referred to as "dwarfism" due to the lateral bowing of the forelimbs, enlargement of the wrist joints and lateral deviation of the forepaws. When believed evident or necessary, radiographs are used for detection of ChD.
This would be covered and a new puppy would be given to the owners. In this case, the defective puppy needs to be returned.


Hip Dysplasia (HD)


The Alaskan Malamute, like most large breeds can suffer from canine hip dysplasia. In its simplest terms, HD is an imperfect formation of the ball and socket assembly in the pelvis. The degree of imperfection can vary from very slight, which often does not visibly affect a dog, to severe, in which the animal is so badly affected that often euthanasia is the only humane course. This is covered with a diagnosis of grade 4 or worse.


The mode of inheritance of HD is not fully understood and even the most experienced researchers, veterinarians and breeders are divided in their opinions as to the exact cause.


Many things can influence hip displaysia. Early spay/neuter, illnesses, injuries, improper exercise, poor diet to name a few. In order for Hip Displaysia to be covered it would need to be proven genetic.


This will not be covered if your dog is spayed or neutered before 18 mos of age. 


Hypothyroidism


This condition is the result of an abnormally low production of Thyroid hormones. Affected animals appear to have a low metabolic rate and are comparatively "easy keepers," requiring small amounts of dietary intake as compared to their size.


Clinical signs vary in intensity with each individual case; dry, coarse and/or sparse coats, ocular discharge, pale mucous membranes, good appetites with normal or above normal weight, mental dullness, slower awkward gait. Diagnosis is made through a blood sample, and treatment is effective in most cases with the oral administration of synthetic thyroid tablets. This is not covered as it is easy to treat.


Heart disease

Congenital Heart Disease. This will be covered if it effects the quality of life.
A new puppy will be provided.



Cancer


Cancers are not in our lines. These are usually caused by environmental things like cleaning supplies, poor diet, treats, plastics, early spay/neuter, and preventive medications. Not hereditary. 



Bloat
This is not covered. Bloat is very serious condition and needs immediate medical treatment.
Not a lot is known about this.  In about 20 yrs of malamutes, 40 yrs of other breeds, I have never had a dog with bloat.  Vets will recommend tacking up the stomach, I honestly don't recommend this. I never recommend unnecessary treatments or preventive treatments. 



Blood disorders


This is only covered if it results in death of the puppy.
A new puppy will be provided. This is not covered if the dog/puppy has had a blood transfusion. 



Polyneuropathy


This will be covered if the dogs is severe and greatly effects the quality of life or if the dog has to be put to be put down.
A new puppy will be provided.



Diabetes

Diabetes is a treatable disorder and not covered.



Epilepsy


Epilepsy is difficult. It is a disorder of the brain. Caused by abnormal electrical bursts that are characterized by seizures. The cause may be hereditary or caused by trauma to the brain or nervous system or a chemical imbalance. This could be covered by us if it is shown to be hereditary. * Will not be covered if the dog/puppy has ever received any preventive treatments or vaccines. Or if the dog suffered an injury. 


Coat Funk

Coat Funk is a coat condition that effects mostly males in mid or older age. It does not effect the health or quality of life.


If we can not prevent it, we can not cover it. But we may chose to if the puppy is young enough and you did your job providing a good quality healthy life.

DO NOT bring your own dogs or other animals with you when visiting, even if you intend to leave them in your car. This can cause distraction as well as “friction” with our dogs. We also have neighbors who we respect and try to keep our dogs calm to eliminate as much noise as possible. Please know that we reserve the right to revoke your right to enter onto our property if we feel that you pose any threat or risk to the safety and well-being of our animals, family members, or property. We expect visitors to have respect at all times, and realize you are visiting a PRIVATE HOME, not a business or “public” place. Do not come under the influence of any drug or alcohol. Please know, specific permission must be granted for each and every single visit. At no time do we expressly give permission for anyone to enter onto our property without a specific appointment day and time. Our property and kennels are are under 24/7 video surveillance.Payments

Please know, that by submitting a deposit payment, you are agreeing to all terms within this contractual agreement, and entering a BUYER CONTRACT, whether signed or not. It applies automatically, to anyone purchasing one of our puppies. Our terms are non-negotiable and must be agreed to, in full, before receiving a puppy.


PLEASE NOTE: IF YOU PAY THROUGH PAYPAL, AND REQUEST A REFUND THROUGH PAYPAL, WE RESERVE THE RIGHT TO PURSUE LEGAL ACTION FOR DAMAGES AS PAYPAL DOES NOT SUPERSEDE OUR BUYER POLICY. THERE ARE NO REFUNDS FOR DEPOSITS,

Please be very clear that I stand by this whether it is signed or not. I cannot make people read it or sign it. It is here for your protection as well as mine. Placing a deposit is as good as signing it. 
Please understand, there are no refunds on deposits.  You are purchasing a puppy, we guarantee you a puppy.  IF we do not produce the sex you want, you can wait for the next litter. If we do not produce enough pups, you can wait for the next litter. If something happens in your life, no problem. We can wait for the next litter. We are flexible. IF you change your mind, there are no refunds. 
IF you choose a pup and before 8 wks we find a genetic defect, you will have a choice to take the pup or wait for a different pup. If you choose to take the pup, you take responsibility. We will give you as much information as possible first and the choice will be yours. If you choose to take the pup, there will be no refunds. We do all we can to produce healthy pups but we are not perfect, no breeder is. 
If at anytime, you disagree with this contract after placing a deposit, you are welcome to small claims court to solve the issue. Taking it public will result in further action. 
We take great pride in producing all around amazing puppies that grow up to be wonderful Alaskan Malamutes. We have a long history of very healthy lines due to the way we raise them. We have great energy, strong bones, beautiful coats, fantastic temperaments. We give them a great start, but it is up to you to continue it. 

We will not be responsible for any problems big or small that are or can be caused directly or side effects from any  "big pharma" products. This includes any vaccines, prescriptions, and preventive drugs. We will also not be responsible for any long term effects from early spay or neutering.
